RUSSIA – New Law on Counter-Sanctions Does Not Directly Restrict Immigration

Effective 4 June 2018, Federal Law No. 127-FZ “On Measures of Affect (Counteraction) in Connection with Unfriendly Actions of the United States of America and other Foreign States” authorises the government of Russia to impose responsive restriction measures on the US and other foreign states at the President’s decision.

The final version of the law does not specifically stipulate the possibility of imposing a ban on the employment of foreign nationals. This may indicate that such a ban is not being considered among the most likely responsive measures.

The United States Department of State has announced that, effective 11 December 2017, the U.S. consulates in St. Petersburg, Yekaterinburg, and Vladivostok will begin to offer limited interviews for non-immigrant visas.

AUSTRALIA – Update on Forthcoming Changes to Permanent Employer-Sponsored Skilled Visas

The Department of Immigration and Border Protection (DIBP) have begun to clarify the changes to permanent employer-sponsored skilled visa programmes that were announced on 18 April 2017.

Significantly, DIBP has announced transitional or ‘grandfathering’ arrangements to permit individuals who held, or had applied for, a subclass 457 visa on 18 April 2017 to access certain existing provisions under the Temporary Residence Transition stream.

UNITED STATES – USCIS Tightens Rules for Green Card Applicants

The US Citizenship and Immigration Services (USCIS) has announced that, effective 1 October 2017, it will eliminate the practice of waiving employment-based adjustment of status interviews, which has been standard practice for approximately two decades.

In another departure from previous standard practice, USCIS has now started to deny Advance Parole applications when the applicant departs the United States, even if the applicant holds H-1B, H-4 or L status.

UNITED STATES – Department of State Temporarily Suspends Non-Immigrant Visa Processing in Russia

The US Department of State has announced that, effective 23 August 2017, US visa operations across Russia will be suspended until 1 September 2017, at which point all US non-immigrant visa applications will only be processed at the US Embassy in Moscow.
