EUROPEAN UNION – Posted Worker Reform Adopted by European Parliament

On 29 May 2018, the European Parliament voted in favour of adopting amendments to the Posting of Workers Directive (1996/71/EC). The amendments were agreed with the Council and the Commission at the beginning of March 2018.

Member states will have two years to transpose the rules into their national laws and must put them into effect by the end of this period.

ITALY – Labour Authorities Step Up Enforcement of Posted Worker Rules

The Italian Labour Inspectorate (INL) has implemented stricter rules and policies on investigating company compliance with Italy’s rules implementing the European Union (EU) Posted Workers Enforcement Directive.

The INL is increasing efforts to detect companies failing to comply with Italy’s rules on the transnational posting of workers – including failures to file timely posted worker notifications with labour authorities and continually rotating posted workers to fill the same position.

BELGIUM – Modified Notification Requirements for Posting Workers

Depositphotos_12113283_originalEffective 1 October 2017, companies posting workers to Belgium must use the LIMOSA declaration – the existing system of notifying the Belgian labour authorities of postings – to notify the Belgian authorities of the nature of the services being carried out, and to appoint their liaison officer.

ROMANIA – New Notification and Document Storage Requirements for Posted Workers

Law 16/2017 of 17 March 2017 transposes into Romanian law European Union (EU) Directive 2014/67 (concerning the posting of workers in the framework of the provision of services), and replaces Law 344/2006.

Effective 20 May 2017, all companies based in an EU or EEA member state or Switzerland posting employees to Romania, as well as Romania-based companies posting employees to an EU or EEA member state or Switzerland, must comply with new notification and document retention rules.

PORTUGAL – New Notification and Document Storage Requirements for Posted Workers

Law no. 29/2017 of 30 May 2017 transposes into Portuguese law European Union (EU) Directive 2014/67 (concerning the posting of workers in the framework of the provision of services).
