CANADA/MEXICO/UNITED STATES – Revised Trade Deal Leaves Work Visa Provisions Unchanged

The new United States-Mexico-Canada Agreement (USMCA), reached between Canada, Mexico and the United States late on 30 September 2018, leaves intact the immigration provisions of the North American Free Trade Agreement (NAFTA), which it will replace if ratified.

Qualifying business persons will continue to be able to travel and work under the same rules as before. The USMCA must still be ratified by lawmakers in all three countries.

SPAIN – Immigration Authorities Suspend In-Person and Telephone Consultations

The Spanish immigration authorities have issued an announcement confirming the temporary suspension of in-person and telephone consultations at both the Large Companies Unit (Unidad de Grandes Empresas – “UGE”) as well as the temporary suspension of in-person consultations at the General Subdirectorate of Immigration.

At the same time, immigration officers are working on clarifying the criteria for approval of applications under the Entrepreneur’s Act.

PORTUGAL – Visa and Residence Procedures Simplified

Regulatory Decree no. 9/2018, published on 11 September 2018, took effect on 1 October 2018.

PORTUGAL – EU Directives Will Take Effect 1 October 2018

Decree Law no. 9/2018, published on 11 September 2018 and effective 1 October 2018, implements the latest amendments to the immigration law, which in turn were published on 28 August 2017.

As we reported here, the 2017 amendments to the immigration law transposed several European Union directives into Portuguese law:

  • (EU) 2014/66 (intra-corporate transfer);
  • (EU) 2014/36 (seasonal workers);

SWITZERLAND – New Integration and language requirements for residence permits

The Swiss Federal Council has approved a package of legislative amendments which, effective 1 January 2019, will allow the authorities to demand that foreign nationals applying for residence permits sign a cultural integration agreement and demonstrate a certain level of language skill.

SWITZERLAND – Reminder: Obligation to Advertise Certain Jobs Now Effective

Effective 1 July 2018, employers wishing to hire foreign nationals for occupations with an unemployment rate of 8% or above have to test the Swiss labour market by advertising. This threshold will be lowered to 5% from 1 January 2020.
