SWITZERLAND – Government Extends “Safeguard Clause” Limiting Residence Permits for Bulgarian and Romanian Nationals

The Swiss Federal Council has decided to extend, for the year from 1 June 2018, the quota on Romanian and Bulgarian nationals (EU-2) of 996 long-term B permits, released quarterly.

BULGARIA – Amendments to the Labour Mobility Law

Effective 23 May 2017, Bulgaria has passed amendments to the Labour Migration and Labour Mobility Act which relax the requirements for issuance of EU Blue Cards for non-EU nationals, increase the allowed ratio of foreign national to Bulgarian national employees and transpose into Bulgarian law EU Directive 2016/801 “on the entry and residence of third-country nationals for the purposes of research, studies, training, voluntary service, pupil exchange schemes or educational projects and au pairing”.

CANADA – Government Lifts Visa Requirement for Bulgarians and Romanians

Effective 1 December 2017, nationals of Bulgarian and Romania no longer need a visa to travel to Canada for short stays (normally for up to six months) for visiting, business and tourism.

However, similar to other visa-exempt travellers, they will need an Electronic Travel Authorisation (eTA) to fly to or transit through a Canadian airport.

European Union flag vintageThe EU ICT Permit, established by the ICT Directive 2014/66/EU, is intended to be a consistent European Union-wide temporary work and residence permit allowing third-country nationals in certain positions to be assigned from a company outside the EU to a company within the EU in the same group, and to easily move and work within the EU.  The United Kingdom, Denmark and Ireland have opted out of this directive.

Despite a November 2016 deadline to transpose the ICT Directive into national law, by September 2017 several EU Member States had not yet fully implemented the directive.  Austria is expected to implement the Directive by 1 October 2017.

SWITZERLAND – Government Invokes “Safeguard Clause” to Impose Quota on Residence Permits for Bulgarian and Romanian Nationals

  • From 1 June 2017, nationals of Bulgaria and Romania (EU-2) will be subject to a new annual quota of 996 long-term B permits, released quarterly.
  • The Swiss Federal Council announced on 10 May 2017 that it would impose the quota, invoking the “safeguard clause” provided for in its bilateral treaty with the EU.

BULGARIA – New Notification and Document Storage Requirements for Posted Workers

Effective 30 December 2016, Bulgaria has implemented EU Directive 2014/67 (concerning the posting of workers in the framework of the provision of services). All employers currently seconding employees to Bulgaria must comply with new notification and document retention requirements by 10 February 2017.
