BRAZIL – New Rules for Residence Renewal Published [UPDATED]

On 25 July 2018, the National Immigration Council published Normative Resolution 30/2018 regulating procedures for the renewal of residence authorisation for foreign professionals, effective immediately.

UPDATE] The Ministry of Labour has published further clarification of the procedures for renewal of work and residence authorisation for those holding permits issued under the previous law.

According to the Ministry, holders of a work permit issued before 21 November 2017 who wish to extend their stay must first obtain a new residence permit under the latest Normative Resolutions. After holding this for two years, they will be able to apply to convert this to indefinite residence.

BRAZIL – Clarification of Procedure for Change of Status from Temporary to Permanent Residence Permit

The Ministry of Labour and the Ministry of Justice have issued a joint statement clarifying that applications for conversion of temporary residence into permanent residence permits must be submitted to the Ministry of Labour for processing, rather than the Ministry of Justice.

BRAZIL – Relaxation of New Police Clearance Requirement for Residence Renewal Applicants

The Ministry of Labour has issued a Technical Note stating that current resident visa holders applying for residence renewal in Brazil are not required to present a legalised and translated police clearance certificate from their country of residence covering the last five years. Instead, these applicants must provide a certificate of criminal record issued by the Brazilian police.

On 22 December 2017, the National Immigration Council published further Normative Resolutions regulating residence authorisation for foreign professionals. The key changes relate to residence authorisation for intra-company training.
