FRANCE – New Temporary Residence Permit for Talent Passport Visa Holders

Effective 1 March 2019, talent passport (“passeport talent”) applicants who have been issued a three-month D visa will now be issued a six-month temporary residence permit (“Autorisation Provisoire de Séjour” or APS) on application for an initial residence permit, post arrival in France.

SWITZERLAND – New National Salary Calculation Tool for Seconded Workers

On 5 March 2019, the State Secretariat for Economic Affairs (SECO) published a new national salary calculation tool that all cantonal labour authorities must now use when conducting remuneration checks to verify the work conditions of seconded workers (temporary intra company transferees or workers posted at a client site to fulfil a service contract).

UNITED KINGDOM – Home Office Introduces New Start-up and Innovator Categories, Reforms Tier 1 (Investor) Category, Amends EU Settlement Scheme

On 7 March 2019, the Home Office published a Statement of Changes in Immigration Rules, introducing new Start-up and Innovator categories and making reforms to the Tier 1 (Investor) category.

The Statement also makes changes to the scope and application process of the EU Settlement Scheme.

VIETNAM – New Notification Requirement for Early Termination of Work Permits

Effective immediately, the Ministry of Labor, Invalids and Social Affairs (MOLISA) has issued a circular which re-introduces the requirement to notify provincial Departments of Labor, Invalids and Social Affairs (DeLISA) of early termination of work permits, and introduces new work permit application forms. Implementation is ongoing and depends on the province.

IRELAND – Spouse or Partner of Critical Skills Employment Permit Holder Can Work Without Employment Permit

Effective 6 March 2019, the spouses and de facto partners of Critical Skills Employment Permit (CSEP) holders can access the Irish labour market without first obtaining an Employment Permit.

In addition, on 1 April 2019 a new pre-clearance policy will be introduced for the non-EEA de facto partners of CSEP holders.
